No right to remove the key
Under the Indian Motor Vehicles Act, 1932, only an ASI level officer can issue you a challan for traffic violation. ASI, SI, the inspector have the right to impose one-time fines. The traffic police are only there to help them. They are not allowed to take away anyone’s car keys. Plus, they can’t even remove the air from your car’s tires. They cannot talk or misbehave with you. If a traffic policeman harasses you without any reason, then you can take action against him.
You should also keep these things in mind
To issue your challan, the traffic police must have a challan book or an e-challan machine. If they do not have any of these, your challan cannot be deducted. It is also necessary for the traffic police to be in uniform. The uniform must have a buckle number and name. If the police officer is not wearing a uniform, he may be asked to present his identity card.
The traffic police chief can only fine you Rs 100. Higher fines can only be imposed by the traffic officer i.e. ASI or SI. This means they can issue bills above Rs 100. If a traffic cop takes your car keys, make a video of this incident. You can go to the police station in that area, show this video to a senior officer and complain.
When driving, you must carry your original driving license and pollution control certificate. At the same time, photocopies of the vehicle registration and insurance can also be helpful. If you don’t have money on hand, you can pay the fine later. In such a situation, the court issues a challan, which will also have to be paid by attending the court. During this period, the traffic policeman may keep your driving license with him.
